What You Should Know About Pumping at Work
Under the Fair Labor Standards Act (FLSA), most nursing employees are entitled to reasonable break time and a private space to express breast milk for up to one year after their child’s birth. Employers must provide a designated space that is functional for pumping, free from view and intrusions, and not a bathroom. This ensures that you have a comfortable and private environment to pump as needed throughout the workday.
In addition, the PUMP for Nursing Mothers Act (PUMP Act), signed into law on December 29, 2022, expands these protections to more workers, including agricultural workers, nurses, teachers, truck drivers, home care workers, and managers. This law helps ensure that all eligible employees have access to the break time and space they need to support their breastfeeding journey.
