Recently Amended Policies - January 23, 2020

On January 23, 2020, the Board of Trustees approved amendment to the following policies:

 

DAA (LOCAL) EMPLOYMENT OBJECTIVES – EQUAL EMPLOYMENT OPPORTUNITY

DAA (LOCAL) was last amended by the Board on February 22, 2018, and it is brought forward by the Administration to align with current practice and protocol. Below are the details of the changes:

 

Page 1: The first paragraph has been revised to read “The Superintendent of Schools or designee shall appoint a representative for purposes of District compliance with antidiscrimination laws. [See DIA(REGULATION)].” A new DIA(REGULATION) has been created.

 

Page 1: The section Accommodation Request under Americans with Disabilities Act (ADA) and associated language has been added.

 

Page 1: The section Procedures to Request an Accommodation under ADA and associated language has been deleted and added to a new DAA(REGULATION).

 

Page 2: The section Reporting Procedures and associated language has been deleted and added to a new DAA(REGULATION).

 

Page 2: In section title Adoption or Last Amended Date, “amended” has been deleted and replaced with “amendment.” In this section, “adopted or” and the date have been deleted, and the anticipated date for Board action has been inserted.

 

DEC (LOCAL) COMPENSATION AND BENEFITS – LEAVES OF ABSENCES

DEC (LOCAL) was last amended by the Board on October 27, 2016, and was brought forward by the Administration to align with current practice and protocol. Below are the details of the changes:

 

Page 1: The first paragraph has been deleted and added as the last paragraph under subsection Family.

 

Page 1: A new paragraph listing federal and state leaves and District-provided leaves has been added.

 

Page 1: Under section Definitions, “throughout this policy” has been deleted after “applied” and has been replaced with “to District-provided leaves.”

 

Page 1: Under subsection Family, “immediate” has been deleted from “family.” In item 1, “including common law and same sex marriage based on documentation and state law” has been added after “spouse.” In item 6, “related to the employee by blood or marriage” has been added after “person.” The last paragraph has been deleted. A new paragraph referencing provisions has been added.

 

Page 1: The section Family Emergency and associated language has been deleted.

 

Page 1: Under section Workday/Day, “Business” has been added before Day in the title. A definition for days has been added. In the second paragraph, “workday/day” has been deleted and replaced with “workday/business day”; “per day” has been deleted after “hours”; and “or days” has been added before “equivalent.”

 

Page 2: Under section Time Off, “TO” has been deleted from the title and added after “Time off” in the first paragraph. In the first paragraph, “or hours” has been after “days”; after “they, “are not at” has been deleted and replaced with “take off”; and order of use language has been added.

 

Page 2: Under section Time Off, item 1, language regarding the number of state days allocated has been deleted and a reference to DEC(REGULATION) has been added. In item 2, “the illness of” has been after “or” and “immediate” has been deleted. In item 3, language regarding the number of local days allocated has been deleted. In item 4, non-duty day language has been deleted. Revised language regarding vacation days from item 5 has been added. Item 5 has been deleted.

Page 2: A new section Non-Duty Days and associated language has been added from item 4 under Time Off.

 

Pages 2-3: The section Days Proration and associated language has been deleted. The section is addressed in DEC(REGULATION).

 

Page 3: The section Compensatory Time and associated language has been deleted.

 

Page 3: The section Use of Days and associated language has been deleted. The section is addressed in DEC(REGULATION).

 

Page 3: The section Cumulative Leaves of Absence and associated language has been deleted.

 

Page 3: The section Priority Return and associated language has been deleted. The section is addressed in DEC(REGULATION).

 

Pages 3-4: The section Neutral Absence Control Policy and associated language has been deleted. The section is addressed in DEC(REGULATION).

 

Page 4. The section Abuse of Leave and associated language has been deleted and moved to another location within the policy.

 

Page 4. Under section Reporting Absences, the first and third paragraphs have been deleted because the language is addressed in DEC(REGULATION). In the second paragraph, “Benefits Outlook” has been deleted and replaced with “the Benefits Department.”

 

Page 4. The section Investigations and associated language has been deleted and moved to another location within the policy.

 

Pages 4-5: The section Medical-Related Leaves and associated language has been deleted. The details for each type of leave are addressed in DEC(REGULATION).

 

Pages 5-6: The section Other Types of Leave and associated language has been deleted. The details for each type of leave are addressed in DEC(REGULATION).

 

Page 6: The section District-Related Leave and associated language has been deleted. The details for each type of leave are addressed in DEC(REGULATION).

 

Page 6: The section Job Abandonment and associated language has been deleted. The section is addressed in DEC(REGULATION).

 

Page 6: The section No-Show and associated language has been deleted. The section is addressed in DEC(REGULATION).

 

Page 6: The section Excessive Absences/Tardies/Dock Days and associated language has been deleted. The section is addressed in DEC(REGULATION).

 

Page 7: The section Exhaustion of Available Days and associated language has been deleted. The section is addressed in DEC(REGULATION).

 

Page 7: The section Attendance Incentive Programs and associated language has been deleted. The District does not have an attendance incentive program.

 

Page 7: A new section Board-Certified Medical Professional and associated language has been added.

 

Page 7: A new section Abuse of Leave and Absences and associated language has been added.

Page 7: A new section Investigations and associated language has been added.

 

Page 7: Under section Return to Work Authorization Following an Approved Leave of Absence, in the first sentence, “from the employee’s health-care provider” has been deleted and replaced with “by a board-certified medical professional with subject matter expertise.”

 

Page 7: The section Maintenance of Benefits and associated language has been deleted.

 

Pages 7-8: Under section Sick Leave Bank, existing language has been deleted. Language regarding membership and a definition for Sick Leave Bank has been added.

 

Page 8: A new section Employee Assistance Program and Fit for Duty and associated language has been added.

 

Pages 8-9: Under section Emergency District Closures, the first paragraph has been revised to read “Absences during emergency District closures such as inclement weather [see CKC(LOCAL)] and/or unforeseen circumstances shall be governed by the Superintendent of Schools and provisions in DEC(REGULATION).” Items 1-2 and the last two paragraphs have been deleted.

 

Page 9: In section title Adoption or Last Amended Date, “amended” has been deleted and replaced with “amendment.” In this section, “adopted or” and the date have been deleted, and the anticipated date for Board action has been inserted.

 

DECA (LOCAL)  LEAVES AND ABSENCES – FAMILY AND MEDICAL LEAVE

DECA (LOCAL) was being brought forward by the Administration to align with current practice and protocol. Below are the details of the changes:

Page 1: The section General Information and associated language has been deleted.

 

Page 1: Under section Definition, “immediate” has been deleted from “family” to align with DECA(LEGAL). The last paragraph regarding additional definitions has been deleted.

 

Page 1: Under Cumulative Leaves of Absence, “cumulative” has been deleted in the section title. “A leave or” has been added after “takes.” Language regarding placement in an equivalent position has been added.

 

Page 1: The sections Medical/Fitness for Duty Certification and Maintenance of Benefits and associated language have been deleted.

 

Page 1: A new section Employee Eligibility and associated language has been added.

 

Page 2: Under section Abuse of Leave, “from a health care provider” has been deleted. A reference to DFBB has been added.

 

Page 2: The section Family and Medical Leave, associated subsections, and associated language have been deleted.

 

Page 2: The sections Concurrent Use of Leave and Combined Leave of Spouses and associated language have been deleted.

 

Page 3: Under section Intermittent or Reduced Leave Schedule, the definition for reduced leave schedule has been deleted from the second paragraph and added as a separate paragraph. In the fourth paragraph, “so long as the employee meets the FMLA standards” has been added at the end of the sentence after “employee.”

 

Page 3: Under section Pay Status, the first sentence has been revised to read “FMLA leave is an unpaid leave. The employee may choose to use state, local, vacation days, and compensatory time to cover the unpaid status of the leave.”

 

Page 3: The section Return to Work and associated language has been deleted and added to a new DECA(REGULATION).

 

Page 3: The section Leave at the End of the Semester and associated language has been deleted.

 

Page 3: The section Recovery of Benefit Cost and associated language has been deleted and added to a new DECA(REGULATION).

 

Page 3: A new section Adoption or Last Amendment Date and associated language has been added.

 

DECB (LOCAL)  LEAVES AND ABSENCES – MILITARY LEAVE

DECB (LOCAL) was brought forward by the Administration to align with current practice and protocol.  Below are the details of the changes:

 

Page 1: Language defining eligibility for military leave and referencing additional policy has been added.

 

Page 1: The section General Information, associated subsections, and associated language have been deleted.

 

Page 1: A new section Pay Status and Duration and associated language has been added.

 

Page 2: The section Military Leave (Short-Term), associated subsections, and associated language have been deleted. Revised language has been added to a new DECB(REGULATION).

 

Pages 3-4: The section Military Leave (Long-Term), associated subsections, and associated language have been deleted. Revised language has been added to a new DECB(REGULATION).

 

Page 4: A new section Abuse of Leave and associated language has been added.

 

Page 4: A new section Adoption or Last Amendment Date and associated language has been added.

The policies have been sent to the Texas Association of School Boards (TASB) for inclusion to the District’s “Policy On Line Manual.” Documents generally will post within a few weeks of adoption.
