Recently Amended Policies - March 26, 2020

On March 26, 2020, the Board of Trustees approved amendment to the following policies:

 

BBD (LOCAL) BOARD MEMBERS – TRAINING AND ORIENTATION

Trustees Justin Henry, Miguel Solis and Ben Mackey brought this policy for amendment, which solely affects the Board of Trustees, now requiring the members to undergo biannual trainings on Robert’s Rules of Order, Newly Revised, with an annual announcement regarding completion of the training by trustees.

 

DCB (LOCAL) EMPLOYMENT PRACTICES – TERM CONTRACTS

DCB (LOCAL) was brought forward by the Administration to align with current practice and protocol.  Below are the details of the changes:

Page 1: A new section title Contracts Required by Law has been added to the first paragraph. “But not limited to” has been inserted after “including” and “instructional coaches” has been inserted after “librarians.”

Page 1. A new section Dual-Assignment Contracts and associated language has been added.

Page 1: A new section Adoption or Last Amendment Date and associated language, including the anticipated date for Board action, has been added.

 

DEA (LOCAL) COMPENSATION PLAN – WAGE AND HOUR LAWS

DEA (LOCAL) was brought forward by the Administration to align with current practice and protocol.  Below are the details of the changes:

Reference to “or designee” has been deleted throughout the policy.

Page 1: Under section Compensation Plan, the last paragraph has been deleted and moved with revisions to DEA(REGULATION).

Page 1: Under subsection Contract Employees, in the last sentence, after the reference to DEA(LEGAL), “for provisions on pay increases and public hearing requirements” has been deleted.

Page 1: Under subsection Noncontract Employees, in the first sentence, “or designee” has been struck after “Superintendent of Schools;” “only” has been struck after “begun;” “a compensation review recommends” has been inserted before “an adjustment;” and “warrants additional compensation be within budgetary constraints” has been struck to end the sentence after “job.” A sentence regarding pay adjustments within budgetary constraints has been added.

Pages 1-2: The following sections with associated subsections and language have been deleted and moved with revisions to DEA(REGULATION): Separation, Benefits/Separation, and Separation Agreements.

Page 3: The section Alternative Work Arrangement and associated language has been deleted and moved with revisions to DK(LOCAL) and DK(REGULATION).

Page 3: The section Adoption or Last Amendment Date and associated language, including the anticipated date for Board action, has been added.

 

DIA (LOCAL) EMPLOYEE WELFARE – FREEDOM FROM DISCRIMINATION, HARASSMENT, AND RETALIATION 

DIA (LOCAL) was brought forward by the Administration to align with current practice and protocol.  Below are the details of the changes:

Page 1: The Note has been deleted and the language has been moved as an introductory paragraph to the policy.

Page 1: The section title Definitions has been deleted. Under this section, “solely for” has been deleted and replaced with “for the.” Unpaid” has been deleted after “and.”

Page 1: The section Prohibited Conduct and associated language has been added from another part of the policy. A reference to DH has been added.

Page 1: The section title Prohibited Harassment has been deleted. Under this section, “sex” has been inserted after “religion.”

Page 1: The section Program Development and Staff Training Department has been revised and moved to another part of the policy.

Page 1: Under section Discrimination, “sex” has been inserted after “religion.”

Pages 1-2: Under section Harassment, “sex” has been inserted after “religion,” and a reference to DH has been added. Under this section, the subsection Examples and associated language has been moved to DIA(REGULATION).

Page 2: Under section Sexual Harassment, a reference to DH has been added, and the subsection Examples and associated language has been revised and moved to DIA(REGULATION).

Page 3: Under section Retaliation, a reference to DH has been added after the first paragraph, and the subsection Examples with associated language has been moved to DIA(REGULATION).

Page 3: The section Prohibited Conduct and associated language has been moved to another part of the policy.

Page 3: Under section Reporting Procedures, the first two paragraphs regarding reporting alleged acts have been revised and moved to DIA(REGULATION). Language regarding the Superintendent of Schools serving as coordinator for purposes of District compliance and designating District representatives with a reference to DIA(REGULATION) has been added.

Page 3: The section title for Definition of District Officials, has been revised to read “District Representatives.” In this section, the Title VII representative has been added, and the Superintendent has been deleted. The paragraph has been revised to read “For the purposes of this policy, District representatives are the Title VII representative, the Title IX representative, the ADA representative, and the Section 504 representative.” The subsections ADA, Title IX, and Section 504 Coordinator and Superintendent have been deleted, and revised language has been moved under section Reporting Procedures.          

Pages 3-4: The section Alternative Reporting Procedures and associated language has been deleted, and revised language has been moved to DIA(REGULATION).

Pages 4-5: The following sections and associated language have been deleted: Timely Reporting, Notice of Report, Investigation of the Report, Concluding the Investigation, District Action, and Confidentiality.

Page 5: The following sections and associated language have been deleted, revised and moved to DIA(REGULATION): Appeal, Records Retention, and Access to Policy.

Page 5: The section Program Development and Training and associated has been revised and moved from another part in the policy.

Page 5: In the section title Adoption or Last Amended Date, “amended” has been deleted and replaced with “amendment.” In this section, “adopted or” and the date have been deleted. The anticipated date for Board action has been added.

The policies have been sent to the Texas Association of School Boards (TASB) for inclusion to the District’s “Policy On Line Manual.” Documents generally will post within a few weeks of adoption.
