In reviewing the M/WBE requirements for the STEM School CMAR RFP, we are trying to evaluate the J/V vs. Teaming Agreement.  On the teaming agreement, will the percentage M/WBE participation for the subcontractor we team with be counted toward the 30% goal?

Answer:

The subcontractor in the prime contractor/subcontractor teaming arrangement can be counted in the M/WBE sub-utilization. However, the subcontractor must submit a best value bid, as determined by the district, in their designated trades during the construction bid phase of the project in order to be considered for award.
